By using the Tunaas.ai platform, you agree to these Terms of Service. Please read them carefully.

By accessing or using Tunaas.ai, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

Tunaas.ai is a platform that enables users to create, fine-tune, and deploy custom AI models through an intuitive interface. The platform provides:

• Model fine-tuning capabilities
• AI model deployment options
• API integration for model inference
• Marketplace for pre-trained models
• Embeddable widgets and integration tools

To access certain features of the platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

4.1 Subscription Plans

Tunaas.ai offers various subscription plans with different features and pricing. Details of our current plans are available on our Pricing page.

4.2 Payments and Billing

By subscribing to a paid plan, you agree to pay all fees associated with the plan you select. Fees are non-refundable except as expressly provided in these Terms. We use third-party payment processors to bill you through a payment account linked to your account. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment processor.

4.3 Subscription Renewals and Cancellations

Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of your current billing period.

5.1 User Content

When you upload content to our platform, including training data, prompts, and configurations ("User Content"), you retain all ownership rights to your User Content. By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing our services to you.

5.2 AI Models You Create

Any AI models you create through our platform remain your intellectual property. You control how they are used, shared, and deployed.

5.3 Marketplace Models

When you publish models to our marketplace, you grant us a license to host, display, and enable access to those models according to your selected settings. If you choose to make your models available for purchase, you retain ownership while granting purchasers a license to use the models according to the terms you define.

5.4 Restrictions

You are solely responsible for all User Content that you upload. You represent and warrant that:

• You own or have obtained all necessary rights and permissions to use and share your User Content
• Your User Content does not violate any intellectual property rights, privacy rights, or other rights of any person or entity
• Your User Content does not contain material that is unlawful, defamatory, or otherwise objectionable

You agree not to use Tunaas.ai to:

• Violate any applicable laws or regulations
• Create or deploy models that generate harmful, illegal, or unethical content
• Infringe upon the intellectual property rights of others
• Send spam or unsolicited messages
• Distribute malware or engage in malicious activities
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with the proper functioning of the platform

We reserve the right to suspend or terminate accounts that violate these policies.

Your use of Tunaas.ai is also governed by our Privacy Policy, which describes how we collect, use, and share information about you when you use our platform.

To the maximum extent permitted by law, Tunaas.ai and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service
• Any conduct or content of any third party on the service
• Any content obtained from the service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for any and all claims arising from these Terms shall not exceed the amount paid by you to Tunaas.ai during the twelve (12) months preceding the event giving rise to the claim.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Tunaas.ai does not warrant that:

• The service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The service is free of viruses or other harmful components
• The results of using the service will meet your requirements

You agree to defend, indemnify, and hold harmless Tunaas.ai and its licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the platform or your breach of these Terms.

These Terms shall remain in full force and effect while you use the platform. We may terminate or suspend your account and access to the platform immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use the platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the platform or delete your account through your account settings.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the platform.

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Tunaas.ai is based, without regard to its conflict of law provisions.
